Subject to any rights or remedies which cannot be excluded, the Supplier, its members, employees and other personnel shall not be liable to the Customer or End Users for any actions, claims, damages, liabilities, costs or expenses in any way arising out of or relating to the performance or non-performance of its obligations under this Agreement or any act or omission of the Supplier. In no event shall the Supplier, its members, employees or other personnel be liable for direct, indirect, special, incidental, consequential or punitive damages, costs, expenses or losses of any kind, lost profits, lost revenue, loss of management time, opportunity costs, failure to realise anticipated savings, lost data, breach of Confidential Information, breach of privacy or unauthorised access to data. The provisions of this clause shall apply regardless of the form of action, damage, claim, liability, cost, expense or loss whether in contract, statute, tort (including, without limitation, negligence) or otherwise.
